Liability of Nanjing zhiyuan Co,Ltd.for breach of this Agreement is limited to actual damage to NOLAND,and in no event shall be greater than the cost of engineering the TECHNICAL INFORMATION which created the liability.Such liability shall not include any consequential damages alleged by NOLAND,or any accounting to NOLAND for speculative profits it may have lost,or for profits gained by others.
