(1) The definitions set forth in Article 1 of the EPC(Engineering,Procurement and Construction) CONTRACT are equally appricable to this DESIGN AGRE EMENT and shall have the same meanings ascribed to them in the EPC CONTRACT unless otherwise defined in this DESIGN AGREEMENT.
(2) The buyer maynot terminate the purchase order due to late delivery during the pierioud during witch liquidated damages accure or thereafter if delivery is made during such perioud.
