a fee of AUD120(or equivalent)will be charged by us for each set of documents containing discrepancies which require obtaining acceptance from our customer.if documents presented under this dc after expiry date and/ or in excess of dc amount,and such discrepancy(ies) are waived by the applicant,an additional,feeof aud100 (or equivalent) will apply.these fees are payable by the beneficiary even where the cerdit terms indicate that some or all of the charges are for the account of the applicant.in accordance with the provisions of art 16C iiib of ucp600,if we give notice of refusal of documents presented under this cerdit we shall however retain the right to accept a waiver of discrepancies from the applicant and,subject to suche waiver being accetpable to us,to release documents against that waiver without reference to the presenter provided that no waritten instructions to the contpary have been received by us from the presenter before the relfast of the documents.any such release prior to receipt of contrary instructions shall not constitute a pallure on our part to hold the documents at the presenter's risk and disposal,and we will have no liabilty to the presenter in repsect of any such release.
Notwithstanding article 10c at the time of presentation of documents the beneficiary must submit a certificate noting those amendments(if any) to the credit that the drawing is made in accordance with,and this certificate must accompany the documents.
We hereby engage with drawers and/ or bona fide holders that drafts drawn and negotiated in conformity with the terms of the credit will be duly accepted and / or paid on presentation/ maturity.All documents must be in the language of the credit.
Insurance buyers care.
On receipt of documents conforming to the terms of this credit,we undertake to reimburse you in the currency of this credit in accordance with your instructions by telecgaphic transfer less aud120 (or equivalent) reimbursement fee.
Negotiating banks discount and/ or interest,if any,prior to reimbursement by us are for the account of the beneficiary.telegraphic reimbursement is not permitted.
