［摘要］在刑事案件中证人能否出庭作证并且所作的证言往往对查明案件事实的真相有着重要的意义,但是我国目前的刑事证人出庭作证制度还存在许多缺陷,导致证人的出庭率低.证人也会受到一些因素的影响,不愿意出庭作证.因此,构建一套完善的刑事证人出庭作证制度,要从这四个方面入手：明确证人出庭作证的范围和例外情况；不出庭作证所面临的金钱处罚和行政处罚；证人及家属保护制度；证人经济补偿制度.同时还要与现实情况相结合.
